Terms of Service

1. Eligibility and account responsibility

The Services are intended only for adults who are at least 18 years old. You may not use the Services if you are under 18, and you agree that any characters or roleplay content you create or interact with must involve adults only.

You are responsible for the accuracy of registration information, the confidentiality of your login credentials, and all activity that occurs through your account.

2. Acceptable use

You may use the Services only for lawful purposes and in a way that does not harm HAZY.chat, other users, third-party providers, or the public.

You may not submit, request, generate, upload, share, or attempt to use the Services for content or conduct that includes:

• sexual content involving minors, grooming, child exploitation, or age-obscured sexual scenarios;
• non-consensual sexual content, sexual violence, bestiality, or incest;
• credible threats, harassment, hate, terrorism, violent extremism, or instructions for wrongdoing;
• self-harm encouragement, medical, legal, financial, or tax advice presented as professional advice;
• infringement of intellectual property, privacy, publicity, or other third-party rights;
• malware, spam, scraping, credential harvesting, automated abuse, or attempts to bypass access restrictions.

3. User content and AI generations

You retain the rights you already have in prompts, character details, images, messages, and other content you submit. You represent that you have the rights and permissions needed to submit that content.

To operate and improve the Services, you grant HAZY.chat a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, modify, and process your submitted content and AI-generated outputs for service operation, safety, support, analytics, and product improvement.

AI-generated characters and messages may be inaccurate, unexpected, offensive, or incomplete. You are responsible for reviewing outputs before relying on, publishing, or reusing them.

4. Credits, payments, and refunds

Certain features may require credits. Credit prices, packages, and availability may change prospectively. Paid credits are delivered after the payment provider confirms a successful transaction.

Payments may be processed by third-party providers, including Infini. We do not store full payment card or wallet credentials on HAZY.chat. Unless required by law or expressly stated at checkout, completed credit purchases are final.

5. Service changes and availability

We may add, change, suspend, or discontinue features, models, characters, pricing, storage practices, or access rules. We may also limit, suspend, or terminate accounts that violate these Terms or create risk for the Services.

The Services may depend on third-party infrastructure, authentication, model, storage, analytics, and payment providers. Interruptions or changes from those providers may affect availability.

6. Intellectual property

The HAZY.chat name, interface, software, design, logos, and service content are owned by HAZY.chat or its licensors and are protected by intellectual property laws.

You may not copy, modify, reverse engineer, scrape, sell, sublicense, or exploit the Services except as allowed by these Terms or applicable law.

7. Copyright complaints

If you believe content on the Services infringes your copyright, contact us with enough detail to identify the work, the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is unauthorized.

If your content was removed because of a copyright complaint and you believe that was a mistake, you may send a counter-notice with the information required by applicable law.

8. Disclaimers

The Services are provided on an as-is and as-available basis. To the fullest extent permitted by law, HAZY.chat disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and accuracy of AI outputs.

9. Limitation of liability

To the fullest extent permitted by law, HAZY.chat will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, goodwill, or service interruption.

Our total liability for any claim related to the Services will not exceed the greater of USD $100 or the amount you paid to HAZY.chat for the Services in the three months before the claim arose.

10. Indemnity

You agree to defend and indemnify HAZY.chat from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of the Services, your violation of these Terms, or your violation of another party's rights.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or safety risk, or used the Services abusively.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where the operator of HAZY.chat is established, without regard to conflict-of-law rules. Before filing a formal claim, each party will try to resolve the dispute in good faith through written notice.

13. Changes and contact

We may update these Terms from time to time. The updated date above shows when the latest version took effect. Continued use after an update means you accept the revised Terms.
